"This article will address these issues by way of providing answers to three important questions that show the dividing lines that run throughout the court systems in the European Union. To address these issues in a comprehensive manner, this article describes these dividing lines along the following themes : (1) the collection of evidence and the use of that evidence across the national boundaries (2) the duality between validity and infringement issues (particularly relevant for patents) (3) the question of whether a court grant an injunction reaching beyond its own national borders (4) use of so-called “torpedo” actions (5) recovery of attorney’s fees and (6) protection of confidentiality or proprietary information or business interests during a litigation."
