Houdster laat gemeenschapsmodel verlopen tijdens beroep

Mc Scotland is houdster van geregistreerd gemeenschapsmodel 598693-0003. Unistraw start een nietigheidsprocedure vanwege het ontbreken van nieuwheid en individueel karakter. Verzoekster ziet bij de Invalidity Division een afwijzing waartegen beroep wordt ingesteld. Houdster heeft in de nietigheidsprocedure haar registratie niet vernieuwd waardoor de RCD is komen te vervallen. Conform artikel 70(1) en (3) CDR komen de (administratieve) kosten van de verzoekster voor rekening van de houdster. De hoger beroepsprocedure wordt door de Kamer van Beroep beëindigd.
7 On 31 March 2011 the Office informed the Design holder of the expiry of the RCD registration as from 3 October 2012. The design holder was invited to submit the correspondent renewal request, by 31 October 2011. A further period of six months was granted in which to submit the renewal request and pay the fees.
8 On 1 August 2012 the Office wrote to the design holder informing that the RCD had not been renewed and had, therefore, lapsed, as from 3 October 2011. The information was published in the Community Designs Bulletin No 148/2012 of 3 August 2012.
11 Since the design holder terminated the appeal proceeding by not renewing the registration of the contested RCD, it must be ordered to bear the fees and costs incurred by the invalidity applicant in accordance with Article 70 (1) and (3) CDR.
