Jos Beeres heeft de domeinnaam louislatour.nl geregistreerd en gebruikt deze om wijnen van het merk Louis Latour aan te bieden. Als er op de link wordt geklikt, wordt men doorverwezen naar josbeeres.nl, waar men ook andere merken aan kan schaffen.
Toepassing Oki-Data-criteria: Oki Data zegt dat je op de website onder de domeinnaam met het merk erin alleen de trademarked goods mag verkopen. Hoever gaat dat? Omdat er, na doorverwijzing naar de eigen site, ook andere wijnen worden aangeboden, is er volgens het panel geen sprake van bona fide gebruik van de domeinnaam. De domeinnaam moet worden overgedragen.
