EUIPO: CARIPHY is auditief identiek aan KARIFY

EUIPO Cancellation Division 25 januari 2017, IEF 16550; IEFbe 2072 (Cariphy ; Innovatie Psychologisch Psychiatrische Zorg tegen Cariphy) Merkenrecht. De verzochte nietigheid is deels toegewezen. Het merk CARIPHY is nietig voor de goederen en diensten in klasse 9 (software and evidence based software in the field of physiothepary), 41 (education), 42 (design and development of software) en 44 (medical services and advice). Het merk CARIPHY blijft wel geregistreerd voor de resterende goederen en diensten in klasse 5, 26, 28, 32, 41 (sports). Met een beroep op IPPZs ouder merk KARIFY wordt aangenomen dat de tekens visueel vergelijkbaar en auditief identief zijn; de letter K/C en f/ph worden gewoonlijk gebruikt als equivalenten met dezelfde klanken. Het is daarom voor het relevante publiek verwarringwekkend voor de goederen en diensten die identiek, gelijk of bijna gelijk zijn.

p. 9. The fact that the parties effectively produce a different type of software, target a different type of public and use different logos in the market is irrelevant because the task of the Cancellation Division is to compare the marks and the goods and services as registered.

The Fact that the EUTM proprietor's company was created before the applicant's company is irrelevant because what matters in the present proceedings is only the question of which mark is earlier. In this case, the earlier Benelux trade mark No 925 311 has an earlier application date thatn that of the contested EUTM and is therefore ,an earlier trade mark within the meanong of Article 53(1)(a) and Article 8(1)(b) EUTMR.
