HvJ EU: Geen sprake van normaal gebruik Spaans woordmerk NN

Beschikking HvJ EU 17 januari 2018, IEF 17454; IEFbe 2465; C-536/17 P(Josel tegen EUIPO) Merkenrecht. Normaal gebruik. Het Hof van Justitie bekrachtigt het arrest van het Gerecht EU [IEF 16908]. Er is geen sprake van normaal gebruik van het merk NN. Het beroep wordt verworpen.

5. On 30 November 2017, the Advocate General took the following position: 

'24. Since the four grounds of appeal are either manifestly inadmissible or manifestly unfounded, I propose that the Court dismiss the appeal.'

7. On that last ground as well as those relied on by the Advocate General, the appeal must be dismissed.
