“The Socialist Members of the European Parliament will next week table a motion in Strasbourg to scrap the McCreevy plan for a new Munich-based court system to oversee patent law. The system would be outside the reach of both the European Parliament and the Court of Justice.
The motion criticises Mr McCreevy’s support for a European Patent Litigation Agreement (EPLA), founded outside the scope of the EU institutions, as weakening EU democracy. The MEPs claim creation of the EPLA would undermine judicial independence, increase litigation costs and expose small- and medium-sized businesses to greater risks.
