Vijfstrepenbeeldmerk K-Swiss terecht nietig verklaard

Gemeenschapsmerk. Beroep ingesteld door de houder van het beeldmerk dat vijf strepen op een sportschoen weergeeft, voor waren van klasse 25, en strekkende tot vernietiging van beslissing van kamer van beroep van BHIM houdende verwerping van het beroep tegen de beslissing van de nietigheidsafdeling tot toewijzing van de vordering tot nietigverklaring die tegen dat merk is ingesteld door Künzli SwissSchuh AG. Beroep is afgewezen, het merk is terecht nietig verklaard.

By decision of 11 January 2011, the Cancellation Division granted the application for a declaration of invalidity pursuant to Article 7(1)(b) of Regulation No 40/94, read in conjunction with Article 51(1)(a) of that regulation. The Cancellation Division observed, in particular, that the contested Community mark, which is presented in the specific form of a design with five stripes, did not constitute an ‘adequate point of contact’ in order to fulfil the function consisting of indicating the commercial origin of the products concerned, that the five stripes placed on the shoe were basic geometric shapes and would be perceived as a technical means to reinforce the shoe or as a pure embellishment of an indistinct, common nature. It inferred from this that the consumer would accord them only fleeting attention.
